MOTION to accept the minutes of April 6 with changes -  Paul / Mike / 6 Yes, 1 Abstain


OSRD BYLAW CHANGES
GCC – We will request an amendment to this warrant that says the “agent and/or Commissioners” will work with the Planner.  We will also prepare a disclaimer that says that discussions at this stage do not indicate commission approval or sign-off on a project or any of its features.

MOTION to renew GCC annual membership to the Essex County Greenbelt Association at $50 level – Tom / Paul / Unam


HEARINGS

129 Elm Street (GCC-2006-10) ANRAD (New)
Reps:  Dan Vasconcelos, WPI; Carol Faraci, Owner

Dan Vasconcelos, WPI – The delineation of the BVW was done by vegetation- there is skunk cabbage, red maple, purple loosestrife, white ash amongst others.  The only structure on this site is an abandoned shed.  There is a culvert for drainage routing water under Elm Street after large storm events.  This culvert is not a state jurisdictional wetland- there is no wetland vegetation or hydric soils, no defined channel.  

Paul N, GCC – I have seen this, it’s actually a swale with water scoured leaves that are brown from water flow.  It is definitely a channel there’s no two ways about it.

Dan Vasconcelos, WPI – We need a site walk with the commission.  

Carl S, GCC –When was this delineation done?

Dan Vasconcelos, WPI – I didn’t do it but I think it was last June or July?  

Mike B, GCC – Bulford Brook is right there, it’s a perennial stream.

Dan Vasconcelos, WPI – On USGS maps the brook ends farther up – it is intermittent at this point according to the USGS.  We didn’t see any flow there when on site last summer.

Mark G, GCC -  What is the significance of the line between the two properties?  I had asked the Agent if this was a separate property.  I was also curious as to why the delineation had stopped half way across 123 Elm.

Dan Vasconcelos, WPI - I’m not sure but I believe this is 123 Elm St.  

Carol Faraci, Owner – The address is definitely 129 Elm Street, not 123 Elm as is stated on the application.  It has been that since the 80,s and I have been paying taxes on it as 129 Elm.

MOTION to authorize Steve to engage a third party reviewer to be completed before site walk – Paul / Tom / Unam

MOTION to continue the hearing to June 1 at 7:30 – Paul / Mark / Unam

Dan Vasconcelos, WPI – I will advise the DEP of the actual address.
